Collective Agreement Questions & Answers

Q. I'm planning a vacation. What additional benefits are available to PSAC members?

A. PSAC membership provides a number of additional benefits in the form of discounts offered by various vendors. An outline of these benefits is available here: Benefits PDF.

Q. I am an AOC working for YTG. I've been told that if I refuse a call to work 3 consecutive times, I could lose my job. Is this true?

A. Yes, though the employer must demonstrate that you were spoken to directly, or sent a registered letter. A telephone message is insufficient. The key word is "consecutive". You may refuse two work assignments, go to work on the third, and refuse the next assignment. That does not constitute 3 consecutive refusals.

Q. I am thinking about retiring soon. Is there anyone I should speak to about this?

A. Yes. If you work for YTG, you should call and make an appointment with the Public Service Commission. They have all the information to help you successfully plan your retirement. If you work for another employer, be sure to contact a financial planner for assistance.

Q. Is there a difference in severance pay if I resign my YTG position or wait until I am eligible to retire?

A. Yes. According to Article 19 of the Collective Agreement (PSAC and YTG), if you resign after 5 years of continuous service, you will receive a half-week of salary for every year of continuous service. Upon retirement, you will receive one week of salary for every year of continuous service (if, on termination, you are eligible for an immediate annuity or allowance under the Public Service Superannuation Act).

Q. Do I need to fill out a leave form to attend a meeting with the Union regarding a grievance investigation?

A. Yes. To request leave to consult with the Union, you must apply under Article 11.05 (3) (a). Such leave will not be unreasonably denied. If the meeting is within your Headquarters area, you will not lose any pay. Members outside the Headquarters area should call the Union because options may be available to cover costs.

Q.
I am under a great deal of personal stress and sometimes have trouble focusing on my work. Is there a program that can help me?

A. Yes. It is called Employee Assistance Program (EAP). This confidential counseling service provides for up to five free sessions each year. Please call 668-3277 for details or to book an appointment. Arrangements may be made to assist members outside Whitehorse within their own community.

Q. Recently I have been feeling quite stressed and upset with what is happening between me and a co-worker. But I don't want to file a grievance. Is there any other way I can deal with this?

A. Yes. In most cases the Union and Human Resources work together to mediate or do alternative dispute resolution. If you think this can work for you, please call the Union office and ask for a Union Advisor. Sometimes mediation is not the answer, although in many cases it works well.

Q. I have some Health & Safety concerns about my workplace. How do I get them addressed before I end up getting hurt?

A. WCH&SB Regulations state that any employer of over 20 employees must have an active Health & Safety Committee in the worksite. Ask your supervisor who is the employee representative on your worksite committee and bring your problem or concern to them. If there is no representative, contact your local Executive or the Union office.

Q. I work in two YTG Auxiliary Seasonal positions, one in the summer and one in the winter. I rarely get sick in the summer, so can I use the sick leave I earn in the summer when I am working in my winter position? 

A. Yes, sick leave is earned by the individual, not by the position. It is also the case that if you accept a permanent or term position, the sick leave that you have earned as an auxiliary seasonal employee comes with you to your new position. Consult Article 25 of the YTG Collective Agreement for more details on earning and using sick leave.

Q. Is leave for corrective eye surgery eligible under the authorization of section 24.05 (1) (b) of the Special Leave section of our YTG Collective Agreement? I am looking into the procedure and it requires going to Vancouver for this. 

A. The appointments and any necessary travel and intervening time would be covered under special leave clause 24.05 Special Leave sections (a) (b) and (h). Any additional time may be taken as sick leave under 25.02 (1).
